A former Childcare director in Far North Queensland pleaded guilty to filming and taking photos of two naked five year old boys. The 31-year-old man has been given a 12 month suspended sentence after serving 55 days in jail.

Daniel Patrick Maher was living with two other men and their adopted son at a house in Cairns during 2011.

The Cairns District Court was told the two men he was living with had been sentenced to substantial jail terms in the United States for offences involving children.

Their adopted son became friends with one of the boys who went to a Childcare centre that Maher worked at.

The court heard police seized electronic equipment from their home and later discovered inappropriate videos of the two young boys.

Maher was arrested and charged the day after he had been sentenced for sending images and videos of young boys to another man in the United States.

Judge Harrison said he believed it was more important for Mahers rehabilitation to continue rather than send him back to jail, as he had already served just under 4 months.
